General terms and conditions
or the limited mail order business (valid from january 1 2019)
1. Delivery scope
The scope of delivery of the limited mail order business is fundamentally restricted to catalogues, other printer products, spare parts and starter sets, which are supplied directly to the end user free of charge. A commercial resale by the end user is not permitted.
Our deliveries are made solely on the basis of our current Terms and Conditions. Differing agreements shall only be binding if they have are confirmed by us in text form. Orders can be submitted by phone, by e-mail, online form, by letter or fax. The orders are processed in the sequence that the orders are received. Deliveries are only possible while stocks last. No minimum order value is required.
3. Terms of delivery / delivery provisos
The merchandise that has been ordered shall be delivered immediately once it becomes available or once the payment has been made. In the case of part shipments caused by the manufacturer longer delivery times may need to be taken into account. We reserve the right to delays or cancellations due to force majeure, delivery difficulties on the part of the suppliers, statutory changes, etc.
Delivery dates and information communicated are non-binding. If an article is no longer in stock we reserve the right to cancel the contract.
4. Prices and terms of payment
All the prices are in EUROS inclusive of the legal rate of VAT. We ship them within Germany exclusively against payment in advance or direct debit. Direct debits within the framework of the SEPA core direct debit scheme are performed whilst stating the crediter identifier and the respective client reference. The pre-notification periods and the submission of the core direct debits are based on the minimum specifications and the minimum terms of the European Central Bank.
Spare parts with a goods value of up to € 15.00 are also available on account, and against payment in advance for a goods value in excess of € 15.00.
Price increases that arise until the time of delivery entitle us to correct the prices.Shipping shall be carried out by a shipper of our choice. The flat shipping rate is dependent upon the scope of the order. The flat shipping fee for spare parts (postage and packaging) currently amounts to:
€ 4.76 for parcels.
We reserve the right to price increases due to price changes on the part of the shipper. The flat-rate shipment charge shall apply to deliveries of goods within Germany. Shipping charges for the delivery of goods outside of Germany shall depend upon the destination country. Information shall be provided on request.
Shipping is free of postage and packaging charges if the order value exceeds € 100.00. All goods, provided they were acquired against payment, shall remain our property until full payment is made.
The following discounts shall apply to the TILLIG standard range. Excluded herefrom are special edition models of the TILLIG-TT-Club, the model railway gallery and promotional goods. Furthermore, no discount shall be granted on any shipping charges.
Quantity discount: In the case of a purchase/order where the value of the goods is 200.00 € or more, we shall grant a discount of 5 % on our RRP or shop price; 10 % where the value of the goods is 300.00 € or more.
Discounts for TT-Club members: Depending upon the value of the goods ordered, members of the TILLIG-TT-Club shall receive a discount of 10 % on our RRP/shop price.
6. Right of cancellation and consequences of returning goods
You can return the goods received without stating any reason within two weeks by sending them back. The term begins at the earliest upon the receipt of the goods and this instruction. The punctual sending of the goods suffices to preserve the time-limit. The goods must be returned to:

Consequences of a return:
In the event of the effective return the performances that have been received by both parties shall be returned and any benefits that have been gained (e.g. advantages in use) yielded. In the event of a deterioration of the goods, or damage, we must demand compensation. The customer has to bear the costs of the return shipment in the event of a return shipment of a delivery of goods the order value of which does not exceed € 100.00 in total if the goods delivered correspond with those ordered. If the value of the goods exceeds € 100.00 a return label can be requested for the return shipment. Shipments which are not paid for will not be accepted.
Original sales packaging:
Please unpack the goods carefully and retain the original for such time until you are certain you want to keep the goods. Never use the original packaging as shipping packaging. Therefore do not stick stickers onto the original packaging of the goods, always use surround packaging. If the packaging of our delivery is ripped open or damaged when you receive it always ensure you have the damage is confirmed by the delivery agent in text form.
The right of cancellation does not apply in the case of printer products.
7. Warranty and compensation claims
Obvious defects, or incorrect deliveries shall be reported to us by the customer within a week of the delivery of the goods. Please expect that the goods are complete or if there are any defects immediately upon receipt of the delivery and inform us in text form of any complaints within a week of receipt. A defect is obvious particularly in those cases when the customer could determine it in accordance with its duty to examine the delivery in accordance with § 377 of the German Commercial Code (HGB).
Claims that are made regarding defects that are not made in time in the case of obvious defects result in the loss of the claims resulting from the defects. Other defects can only be complained about within a notice period of 24 months from the arrival of the goods at the place of destination. The claim regarding a defect must be made in text form whilst the defect must be precisely described. Our warranty is exclusively limited to subsequent improvement, a replacement delivery of the goods, or the granting of a credit note.
We have the choice of a replacement delivery or subsequent improvement. The ordering party can demand a reduction of the remuneration or the cancellation of the contract in accordance with its choice if the subsequent improvement or the subsequent delivery is unsuccessful.
More far reaching claims, in particular consequential damage due to defects, shall be excluded. Only our direct customers are entitled to warranty claims against us and they cannot be assigned.
The legal provisions concerning warranty shall apply.
8. The place of performance and place of jurisdiction
The place of performance and place of jurisdiction for all performances and obligations shall be the registered office of our company.
The General Terms and Conditions of Business shall apply from 1 january 2019 until further notice. We reserve the right to price changes, changes in colours and designs and amended delivery options. Specifications, dimensions and illustrations are subject to correction.
The ordering parties recognise our general terms and conditions of business upon the placement of an order. If one of the aforementioned conditions should be ineffective, the remaining conditions shall remain unaffected.
